In Alberta, ownership of the land and the air above (surface), and ownership of the mines and minerals below (subsurface), are usually separated. This has potentially significant implications for privately conserved lands because a parcel that is ’secured’ by a land trust deals only with surface rights. Additionally, the owner of the subsurface rights must be given the opportunity to access and exploit that right.
